When placing your order, you must accept the GTC by checking the box “I accept the Terms and Conditions of Sale” in full and without reservation. The GTC can be downloaded here.
The GTC are supplemented by the Privacy Policy Statement (link be inserted) which governs the collection and processing of clients’ personal data.

1. Scope of application
1.1. The following General Terms and Conditions of Sale (GTC) apply to any user of the Julia Heuer online shop on the www.julia-heuer.com website, and exclusively to the relationship between Julia Heuer SAS and the client (the “Client”), for any purchase by the Client in our online shop. The GTC apply in the version in force at the time of the order.
1.2. The products offered in the online shop are only sold to consumers who are natural capable persons and not to commercial resellers. No orders will be accepted outside. Further restrictions on delivery can be found in section 6.1.
1.3. In order to place an order, the person placing the order must be at least 18 years of age, be reachable by telephone and have a valid e-mail address.
1.4. When placing an order, the Client accepts the GTC by ticking the box “I accept the General Terms and Conditions of Sale” in their entirety and without reservation. The Client thus acknowledges having read these GTC. Julia Heuer SAS reserves the right to modify these general conditions at any time without prior notice, with effect for the future only.
2. Products
2.1. Prior to placing an order, the Client may take note of the products offered for sale in the online shop, and in particular with the essential characteristics of the product or products.
2.2 Julia Heuer SAS draws attention to the fact that, as our products are characterised by particular colours and fabrics, the photographs may vary slightly from reality, depending in particular on the configuration of the electronic device used by the Client.
2.3. Julia Heuer SAS reserves the right to withdraw products from the online shop at any time.
3. Ordering products
3.1. The Client may purchase the products offered in our online shop while stocks last. The order is placed as a visitor, without the need to create a customer account.
3.2. The Client is guided through the purchase process, which consists of various steps. When the Client uses the shopping cart function - after clicking on “Confirm cart” - the essential data of the product, the price and any costs incurred, are summarised. The Client submits to Julia Heuer SAS an offer for the conclusion of a sales contract for the selected products. As soon as the order is sent to Julia Heuer SAS, the Client receives an e-mail confirming the receipt of the said order by Julia Heuer SAS. This e-mail is an order confirmation specifying the details of the order such as the products concerned, the billing and delivery addresses and the chosen method of payment. This order confirmation is not an acceptance of the Client’s offer but informs the Client, in the first instance, that his order has been received by Julia Heuer SAS. The contract is concluded once the Client has confirmed payment and the amount has been debited.
3.3 Julia Heuer SAS only offers for sale the products listed on the online shop in quantities usual for households. For this reason, Julia Heuer SAS reserves the right to refuse or cancel an order, if such an order does not correspond to the usual consumer quantities or if it is made by a Client with whom there is a dispute, for example for a previous payment incident. The Client will be informed in this case by e-mail or telephone at the address communicated by the Client at the time of ordering.
3.4 The contracts concluded in the online shop with Julia Heuer SAS are concluded in French or English, depending on the language chosen.
4. Prices and shipping costs
4.1. The applicable prices are those listed for each product in the Julia Heuer online shop at the time of the order.
4.2 All prices displayed are in Euros and include all taxes, excluding shipping costs. Any packaging and shipping costs are indicated separately at the stage at which the Client places the order. Orders placed outside the European Union may be subject to taxes and customs duties which are notified when the delivery reaches the Client. 5. Payment terms
5.1. The purchase price is to be paid immediately.
5.2. The Client may pay the purchase price as follows:

This withdrawal period shall run from the day on which the Customer or a third party designated by the Client, who is not the carrier, has received the goods. If this period expires on a Saturday, Sunday or public holiday, it shall be extended to the first working day.
7.2. In order to exercise your right of withdrawal, the Customer must inform Julia Heuer SAS in writing of his decision to withdraw, at the following address:
Julia Heuer SAS
43, Rue de la Reunion

Effects of withdrawal
7.4. In the event of withdrawal by the Client, Julia Heuer SAS will reimburse the Client in full the sums paid by the Client, including delivery costs (with the exception of additional costs arising from the fact that the Client has chosen, where applicable, a delivery method other than the less expensive standard delivery method proposed by Julia Heuer SAS) without unjustified delay and, in any case, at the latest 14 days from the date on which Julia Heuer SAS is informed of the Client's decision to withdraw from the order. Julia Heuer SAS will proceed with the reimbursement using the same means of payment that the Client used for the initial transaction, unless the Client expressly agrees to a different means. The Client shall not bear any reimbursement costs. The refund may be deferred until the returned goods have been received or until the Client provides proof of shipment of the products, whichever comes first.
7.5. The Client must return the product to Julia Heuer SAS without undue delay and, in any case, at the latest 14 days after the Client has communicated his/her decision to withdraw from the sales contract. This period is deemed to have been respected if the Client returns the goods before the expiry of the 14-day period.
7.6. The Client shall only bear the direct costs of returning the products. In the event of payment of customs duties by the Client, the latter is required to be reimbursed for the customs duties paid. However, Julia Heuer SAS will take charge of any eventual new customs duties upon entry into France.
7.7. The Client shall only be liable for the depreciation of the product resulting from handling other than that necessary to establish the nature and characteristics of the product.
Exceptions to the right of withdrawal
7.8. Unless otherwise agreed by the parties, the right of withdrawal does not apply to contracts for the delivery of goods produced according to specific criteria, or tailor-made for the Client’s personal needs.

8. Liability for defects
8.1. The products sold by Julia Heuer SAS benefit from the legal guarantee against hidden defects and that relating to conformity for consumer Clients.
The consumer has a period of two years from the delivery of the products to act. They may choose between repairing or replacing the products, subject to the cost conditions set out in Article L. 217-9 of the French Consumer Code.
Defects of conformity that appear within twenty-four months from the delivery of the products are presumed to have existed at the time of delivery, unless proven otherwise.
The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.
The consumer may decide to invoke the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the French Civil Code. In this case, the consumer can choose between the cancellation of the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code.
The conditions for implementing these legal guarantees are recalled below:
“The legal guarantee of conformity (Articles L. 217-4 to L. 217-13 of the French Consumer Act)
The professional seller must deliver goods that conform to the contract. Failing this, he is liable for defects at the time of delivery, but also for all those resulting from the packaging, assembly instructions or installation when it is the responsibility of the contract or under his responsibility (Article L. 217- 4).
Conformity of the goods
According to Article L. 217-5, a good is in conformity when it either:
• fits for the use normally expected of similar goods, if any, etc.:
• corresponds to the seller's description and has the qualities presented in the sample or model;
• has the qualities that a consumer may legitimately expect following the public statements of the seller, producer or representative (advertising, labelling, etc.). The declarations of the latter two professionals are not binding on the seller when the latter does not know them and is not in a legitimate position to know them.
• has the characteristics defined by the parties or fits for the special use intended by the buyer, known to the seller and accepted.
Time limits
An action for a guarantee of conformity shall be barred after two years from the date of delivery of the goods.
Exceptions
The consumer may not invoke the guarantee of conformity under Article L. 217-8 in three cases:
• when he/she was aware of the defect at the time of contracting;
• when he/she could not have been unaware of the defect at the time of contracting;
• when the defect results from materials that he/she himself/herself supplied.
Implementing the guarantee of conformity
Where there is a lack of conformity, the professional shall offer the consumer a replacement or repair. The choice is up to the consumer, except where this choice entails disproportionate costs for the professional compared to the other remedy.
The consumer may obtain the cancellation of the contract or its reduction (reduction of the price of the goods) if the defect is not minor and the time limit for the chosen solution exceeds one month from the request; or no remedy is feasible.
The consumer may not be charged for the replacement, repair, cancellation, or reduction of the contract.
The legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code)
The seller is bound by the guarantee for hidden defects in the item sold which make it unsuitable for the intended use, or which reduce this use to such an extent that the buyer would not have acquired it or would only have paid a lower price for it if he/she had known about them.
The legal guarantee covers all costs incurred by hidden defects.
The professional shall not be liable for apparent defects of which the buyer has been able to detect himself/herself, but for hidden defects, even if he/she did not know about them, unless he/she has stipulated that he/she shall not be bound by any guarantee.
The defect must be prior to the sale and render the products unsuitable for the use for which they were intended.
The buyer has the choice between:
• returning the goods and having the price refunded;
• keeping the goods and having part of the price returned.
The time limit to act is two years from the discovery of the defect.
The Client may contact Julia Heuer SAS to obtain any information relating to the exercise of these guarantees, at the following address:

9. Choice of law
These GTC and all disputes and claims in connection with them are subject to French substantive law. This clause shall in no way prevent the Client, as a consumer, from benefiting from mandatory provisions in his country of habitual residence.
10. Personal data and cookies

The purposes, recipients and conditions under which Julia Heuer SAS collects and processes personal data in connection with the use of the online shop are presented and specified under the Section Privacy Policy Statement.
11. Other provisions and force majeure
11.1 If any of the above clauses is or becomes invalid or unenforceable, this shall not affect the validity of these GTC as a whole or the contract of sale between the parties.
11.2 Julia Heuer SAS cannot be held responsible for the partial or total non-execution of its obligations under these GTC, if this non-execution is caused by an event of force majeure, as defined in the French Civil Code, including the case law of the French courts.
12. Disputes and Mediation
12.1. In the event of a dispute arising from an order in the Julia Heuer online shop, or its delivery, which could not be settled in the context of a prior complaint directly submitted to Julia Heuer, the Client shall have the possibility of seeking an amicable solution with Julia Heuer SAS, and of having recourse to mediation for consumers with [the Federation of E-Commerce and Distance Selling (FEVAD - https://www.fevad.com/) and the E-Commerce mediation service (60 rue la Boétie, 75008 Paris) - relationconso@fevad.com ].
12.2 In addition, the European Commission provides an online dispute resolution platform (OS) at http://ec.europa.eu/consumers/odr/.
12.3 In the event of legal action against persons who have moved their place of residence or habitual residence abroad after the conclusion of the contract or whose place of residence or habitual abode is not known at the time the action is brought, the registered office of Julia Heuer SAS - Paris - is decisive.
